Homebuilders’ New Home Lotteries Not Considered Illegal Gambling
Question: I was looking for a home in the Southeast Valley last month. In speaking with a sales agent who represented one homebuilder in the Southeast Valley, I was told that this homebuilder does not do a lottery for new homes like many other homebuilders in Arizona. The position of this homebuilder is that a lottery is illegal gambling and that homebuilders who use a lottery to sell homes could be subject to criminal penalties. Is a lottery by a homebuilder to sell homes illegal gambling?
Answer: Probably not. A lottery in which consideration is given, e.g., $100, is generally illegal gambling subject to criminal penalties, unless otherwise exempt. A major exemption is a charity raffle. For example, a charity can lawfully sell $100 tickets for a lottery to win a new car. If no consideration is given by a participant in a lottery, however, there is no illegal gambling. Most homebuilders who use a lottery to sell homes do not require any consideration, inasmuch as the only requirement is that the potential buyer of the new home register for the lottery. Therefore, this type of lottery by a homebuilder is not illegal gambling.
