Buyer Can Cancel after Inspection
Period for Seller’s Failure to Disclose Roof Leaks
Question: In the Seller's Property Disclosure Statement (SPDS), the seller said that there were no problems with roof leaks in the home. The buyer's home inspector found no roof problems. After the
inspection period had expired, there was a major
storm, and the roof had significant leaks. The
buyer's roof expert furnished a written opinion
that these roof leaks were not new. The seller
finally admitted that there had been prior roof
leaks. Can the buyer cancel the contract after the
inspection period because of the roof leaks?
Answer:Yes. The fraudulent or negligent failure
of the seller to disclose the roof leaks entitles the
buyer to cancel the contract upon discovery, even
after the expiration of the inspection period.
