Claims for Non-Disclosure Potentially Waived by Failing to Inspect Property Prior to Closing
Question: We are a retired couple who recently purchased a four-year-old condominium in the Kierland area of north Scottsdale. At the time of the purchase we had the home inspection report which showed that the hot/cold water in the shower was backwards. We were anxious to move into the condominium, however, and did not ask to have the shower fixed by the seller. We moved into the home and immediately noticed that the toilet ran hot water only. Neither the seller nor the home inspection report disclosed this problem to us. In addition, due to settling of the condominium the front door will not close properly and floor tiles are cracking. The seller and the home inspection company will not take any responsibility. Do you have any suggestions, or do we remain on the “hot seat” and take out rear end burn insurance?
Answer: If you knew that the hot/cold water in the shower was backward, but made no further investigation, you may have waived any claim against the seller for failing to disclose that the toilet ran hot water only. How much is rear end burn insurance! On the other hand, if the seller knew of the settling problem, and the home inspection company negligently failed to discover the settling problem, you may have a claim against both the seller and the home inspection company. In addition, you may have a claim against the builder of the condominium for the settling problem, as a subsequent buyer generally has six years after completion of construction to file a lawsuit against a builder for construction defects not discoverable by inspection at the time of purchase.
