Both Signatures Required to Sell Community Property
with Right of Survivorship Property (11/30/02)
Question: My husband and I own a home in North Phoenix
as community property with right of survivorship. We had an argument
recently, and my husband signed a contract to sell our home to an
investor buyer. My husband no longer wants to sell. Do we have to
sell our home? Will my husband be sued if we don't?
Answer: Inasmuch as you owned your home as community property
with right of survivorship, under Arizona law both of you would
have to sign the contract to sell your home. Your husband should
have no liability because the contract is not enforceable. Note:
If you and your husband owned the home as joint tenants with right
of survivorship the contract would be valid, and at closing you
and the investor buyer would be owners of the house together as
tenants in common.
