Question: We purchased our home in Apache Junction eighteen
months ago. The monthly HOA dues at that time were $110.00 per
month. Our board of directors requested a special assessment for
improvements in the common area for flood control and landscaping.
This special assessment was voted down by the homeowners. The
board of directors has now increased the HOA monthly dues to $130.00
per month in order to pay for the flood control and landscaping
expenses. Many of us in this senior community are on fixed incomes,
and this unjustified raise in the HOA dues is a financial burden.
Is there anything we can do?
Answer: Probably not. The raise in the HOA monthly dues
from $110.00 to $130.00 per month is within the general 20% maximum
annual increase in HOA dues per A.R.S. §33-1803. Unless the board
members are violating their fiduciary duty to the members by raising
the HOA dues, you probably have no recourse.
